These General Terms and Conditions, short AGB, of The PatchFactory, Holmfors 4, 914 94 Nyåker, Sweden ( Owner: Andree Mike Koriath ), are valid for and about all contracts on this platform ( Internet Shop: https://www.the-patchfactory.com ) are made. We hereby expressly exclude the terms and conditions of the seller, unless these are approved separately and in writing and recorded in advance and signed by both parties.

The PatchFactory sells the items offered in the online store ( https://www.the-patchfactory.com ), also under the name / pseudonym "DerAufbügler" (www.deraufbuegler.eu). This name is used exclusively to offer the articles in the German-speaking area on the Etsy sales platform. It is the name / pseudonym merely a more understandable translation of the product in the name.

Consumer and or buyer, in the sense of these terms and conditions, is any natural person who is fully competent to do business before the law. Legal persons in the sense of associations or companies always have a natural contact person.

All offered articles in the online store (https//www.the-patchfactory.com) are basically property of called The PatchFactory (owner: Andree Mike Koriath). This applies in particular to motifs, as well as motifs in word and image and motifs consisting only of Word. All our motifs, as well as motifs in word and image and motifs consisting only of word, have a time stamp in the manufacturer / raw file, so that can be determined exactly when this motif was created.

In case of fabrications especially on customer's request, the right of use falls to the customer, but the product itself remains property of The PatchFactory.

We strictly refuse fabrications of branded articles or branded products, until the presentation of a certified release, for the processing of the motif from the owner or his authorized person. This must be presented to us by the client and must be issued by the owner of the trademark right. We reserve the right to check this release and to refuse the order in case of ambiguity.

The PatchFactory assumes no liability and / or responsibility, should our motifs, above in word and image combined, or as a custom-made, alienated purpose and this then lead to confusion and or equality of well-known brands.

The customer can compose all articles in the online store individually and order them arbitrarily in the offered colors and in the number of pieces of his choice. Some articles can be further or extra individualized, for this they are requested in the corresponding article to make further details.

All articles which can be ordered at The PatchFactory Online Shop ( https://www.the-patchfactoy.com ) will be manufactured by us individually in color and if necessary further individualizable information by the customer, after successfully completed order process.

For customers, guest accounts or visitors of the online store ( except Etsyshop ) the prices are displayed including the statutory value added tax, for Sweden currently 25%, .

For a merchant account, which is provided by us with separate conditions, the prices are displayed in net.

VAT is shown separately in the invoice only for the online store ( https://www.the-patchfactory.com ). The sale via the online platform Etsy is tax free. The buyer is responsible to pay any taxes.

The customer / buyer can personalize each article. This can be done on the one hand for certain articles, provided with additional information, such as names or numbers. With articles, where the indication of a personalization data is given, e.g. desire name / desire word the article is manufactured in accordance with the data in the article.

In the case of special designs, which e.g. enlargements or reductions of one of our articles is desired, the customer must contact us in advance. This can not be adjusted after the ordering process.

Special orders, which are made according to the customer's wishes, such as logo creation or similar, we will discuss in writing and by phone. The pricing is based on the effort and material consumption.

The online store will automatically send an order confirmation to the customer after a successful order process. We ask you, if you should not have received this, to look in advance in the spam folder. Also the sending / receiving of a mail can take some hours (24 hours are given by some providers as a guideline). We therefore ask you to wait this time at most, or to contact us separately before completing a new order process.

After completion of the order process by the customer, it comes to a legally valid purchase contract. This can not be revoked on the part of the buyer, due to the customization process.

You can pay in our online store with advance payment, PayPal or credit cards, Giropay, iDEAL, Sofort and Bancontact as well as on account .

When paying in advance, you will receive the account information after the ordering process via mail. These include IBAN and BIC numbers, bank name and bank location. Please transfer the invoice amount in the currency in which you ordered. Any transfer costs are not entitled to be deducted from the purchase price. Within the EU, or in Europe's member countries with SEPA, there are no extra transfer costs. Depending on the bank and country a transfer can take up to 5 business days.

PayPal is a payment service provider. The terms of use can be found at https://www.paypal.com. For customers with a PayPal account, the terms of use are stored in the respective customer account. To make payments with PayPal or through PayPal they do not necessarily have to have a PayPal account, you can find more information about PayPal ( https://www.paypal.com ).

Credit cards, Giropay, iDEAL, Sofort and Bancontact are settled via the payment processor Stripe. The terms of use are available at Stripe ( https://www.stripe.com ). The payment options offered depend on the country from which the order is placed.

Payment on account is only possible for customers in Germany and Sweden. The purchase on account is reserved exclusively for registered customers from the 2nd order. A maximum of 100 euros in outstanding invoices can be accumulated per customer. A maximum of 50 euros of invoice is allowed per order. The invoice amount must be credited to the specified account within 14 days after placing the order. In case of non-payment of the invoice amount, we reserve the right to initiate a judicial dunning procedure.

Until full payment of the goods, they remain the property of The PatchFactory.

7)

Shipping is done via letter mail by the Swedish PostNord. Information and conditions can be found at https://www.postnord.se for further information. Each letter shipment has a Shippment ID, which clearly proves that the shipment was made to the delivery address. The shipment will only be sent to the delivery address provided by the buyer.

Our stated shipping times refer to production times and delivery times by PostNord. The stated delivery times are estimated times, these delivery times are not binding.

If the shipping company returns the goods to The PatchFactory because the shipment was not deliverable, the customer is responsible for shipping costs, as well as additional shipping costs after confirmation by the customer that the given delivery address is correct.

The customer is obliged to check the goods immediately after receipt for possible errors or defects.

Reasons for complaint are not, stripes on the goods, or possibly kinks in the carrier film.

We ask you to send us a picture of the goods to be complained about, if possible also detailed photos. Do not return the ordered goods without contacting us in advance.

Coupons or discount coupons can be entered independently in the checkout process. Subsequent entry by The PatchFactory is not possible.

The PatchFactory does not sell vouchers. A voucher is issued by The PatchFactory and is sent directly to the customer.

The voucher is entered exclusively by the customer. In case of loss the customer is liable.

10)

Merchant accounts are set up manually by us. The prizes for merchant accounts are exclusive of VAT.

A calculation of the VAT depends on the VAT-ID number.

Merchant accounts or commercial customers receive separate terms and conditions, which are clarified individually and personally with the respective persons and put down in writing.

The application for opening a merchant account and the corresponding tax exemption can be found in the customer account.

This platform serves as a contact point for the out-of-court settlement of disputes arising from online purchase or service contracts involving a consumer.

The PatchFactory is neither obliged nor willing to participate in a dispute resolution procedure before a consumer arbitration board..
